Welcome to Thangka Khorlo (the "App"). By downloading, installing, or using the App, you agree to comply with and be bound by the following Terms of Service ("Terms"). Please read these Terms carefully before utilizing the App.
1. Acceptance of Terms
By accessing or using Thangka Khorlo, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you may not download or use the App.
2. Description of Service
Thangka Khorlo is a mobile application developed for iOS devices designed to showcase digital high-definition Tibetan Thangka art, provide detailed symbolic iconography analysis, and simulate a virtual Buddhist prayer wheel (Khorlo) for meditation purposes.
3. Intellectual Property Rights
All content displayed within the App, including but not limited to digital representations of Thangka art, geometric mandalas, text descriptions, translations, audio recordings, software code, graphic designs, and logos, is the property of Thangka Khorlo or its content suppliers and is protected by international copyright, trademark, and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the App for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from the App without express prior written consent from us.
4. Respect for Sacred Imagery
The imagery represented in this application holds deep spiritual, cultural, and historical significance. We request that all users engage with the artwork and digital tools with appropriate respect and mindfulness.
5. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
We do not warrant that: a) the App will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; or c) the results of using the App will meet your personal expectations or requirements.
6. Limitation of Liability
In no event shall Thangka Khorlo, its developers, partners, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the App; (ii) any behavior or content of any third party on the App; or (iii) unauthorized access, use, or alteration of your transmissions or content.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide notice by updating the "Last Updated" date at the top of these Terms. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
